DMCA & Copyright Policy

FutureMD.org respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted the following policy toward copyright infringement on the FutureMD.org website.

Reporting Claims of Copyright Infringement We take claims of copyright infringement seriously. We will respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws. If you believe that your copyrighted work has been infringed upon on our website, please notify us immediately.

To file a notice of infringement with us, you will need to provide a written communication that includes the following:

     

      • An electronic or physical signature of the person authorized to act on behalf of the copyright owner;

      • A description of the copyrighted work that you claim has been infringed;

      • A description of the location where the original or authorized copy of the copyrighted work exists (e.g. the URL to the page of our website that contains the material);

      • Your address, telephone number, and email address;

      • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law;

    • A statement, made under penalty of perjury, that the information provided in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

    We may send the information provided in your infringement notice to the person who provided the allegedly infringing content. That person may elect to send us a counter-notice.

    Counter-Notification Procedures If you receive a notice from us that your content was removed for alleged copyright infringement, you may provide us with a counter-notification in response. To file a counter-notification, you will need to provide a written communication that includes the following:

       

        • Your physical or electronic signature;

        • Identification of the content that was removed from our website and the location at which it appeared before it was removed;

        • A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification;

        • Your name, address, and telephone number; and

        • A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or the federal district court located in Florida), and that you will accept service of process from the complainant.

      Please send your counter-notification to our designated copyright agent at legal@futuremd.org. When we receive a valid counter-notification, we will forward it to the party who submitted the original claim of copyright infringement. Please note that when we forward the counter-notification, it includes your personal information. By submitting a counter-notification, you consent to having your information revealed in this way.

      We will then wait 10-14 business days before restoring the content to our website. This waiting period gives the claimant time to file a lawsuit against you for infringing their copyright. If we receive notice within 14 business days that a lawsuit has been filed against you relating to the claimed infringement, we will not restore the content while that lawsuit remains open.

      Repeat Infringer Policy In accordance with the DMCA and other applicable law, FutureMD.org has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website and its content and services for any users who infringe any intellectual property rights of others, whether there is any repeat infringement.

      Modifications We may modify this DMCA policy from time to time in order to comply with changes to copyright law, DMCA requirements, or other applicable laws and regulations.
